Terms & Conditions
1.1. Client: The person, organisation, company or other body which is hiring the goods as specified on the Booking Form.
1.2. Event date: The time and date of the event, confirmed by Mr Incredibooth and noted on the Booking Form.
1.3. Booking Form: The form signed by, or on behalf of, the client and Mr Incredibooth specifying details of the booking.
1.4. Day: A calendar day, unless specified otherwise.
2. Booking Confirmation
2.1. A booking is not confirmed until the customer returns the Booking Form, pays the non-refundable deposit of $250 and receives confirmation of the booking from Mr Incredibooth.
2.2 By paying the deposit you acknowledge that you have read, understand and accept these terms & conditions.
2.3 If the deposit is not received after 7 days of booking request, Mr Incredibooth may at its discretion decline your booking request.
3.1. A non-refundable deposit of $250 is payable upon booking. The booking is not confirmed until the deposit is received by Mr Incredibooth.
3.2. The balance of the hiring costs of the photo booth is payable 14 days before the event date.
3.3. If the balance of the hiring costs of the photo booth is not received at least 14 days before the event date, Mr Incredibooth may at its discretion cancel the booking and the deposit will be forfeited.
4. Access, space & power requirements
4.1. It is the customer’s responsibility to ensure a safe and appropriate environment is provided to Mr Incredibooth’s personnel to install and operate the photo booth at the event venue.
4.2. It is the client’s responsibility to ensure the minimum specification is provided at the event venue for the installation of the photo booth (“Minimum Requirements”):
- a space of 2m x 2m or more
- access to 240v power within 10m of Mr Incredibooth’s equipment
- all doorways and access paths are at least 80cm wide
- if an outdoor event, an undercover area if any chance of poor weather
- internet reception is active at the venue location if using the free standing social kiosk. Mr Incredibooth will not be at fault if the internet connection effects the use of the free standing social kiosk. Mr Incredibooth uses Telstra 4G internet.
4.3 If the Minimum Requirement is not met, then Mr Incredibooth reserves its rights to cease providing the Service and the amount paid by the Customer will be forfeited.
4.4 In addition to the Minimum Requirements specified in Clause 4.2, Mr Incredibooth may also require a survey of the event location if it has concerns about its suitability in installing a photo booth. If this is required, the customer will be charged an additional fee of $50 in respect to the survey conducted.
4.5 The client is responsible for paying any charges or fines imposed by the venue, or required to access the venue or excess charges getting to the venue. These charges may include, but are not limited to, parking, electricity, ferry fees, tolls.
5. Changes & cancellations
5.1. Requests for changes of the event date must be made in writing via email. No request will be accepted via a phone call.
5.2. All cancellations will result in the client forfeiting the deposit if the cancelation is made outside of 14 days from the event date.
5.3. Cancellations made within 14 days of the event date will result in the client forfeiting all payments (the deposit and the balance of the hiring costs) made to Mr Incredibooth.
5.4. Mr Incredibooth can cancel any booking at any time for whatever reason. If Mr Incredibooth decides to cancel a booking, all payments made will be refunded to the Customer.
6.1 If the customer requests the use of Mr Incredibooth’s services and equipment in excess of the time specified in the Booking Form, then the extra time will be charged at the rate of $200 for each additional or part hour payable in cash at the time of requesting extra time.
6.2 Mr Incredibooth reserves its right to decline any request for overtime.
7. Damage to the photobooth and equipment
7.1. In order to prevent damage to the photo booth and equipment, Mr Incredibooth reserves the right to deny service to any person at the event.
7.2. If circumstances arise where a threat or implied threat of harm, damage or violence to Mr Incredibooth’s staff or equipment, Mr Incredibooth reserves the right to cease providing the service. If the client is able to resolve the threatening situation within 20 minutes, Mr Incredibooth will resume services. If the situation is unable to be resolved, Mr Incredibooth will not resume providing service and the customer will receive no refund of hiring cost.
7.3. Any damage to Mr Incredibooth’s photo booth or equipment during the customer’s event caused by the customer, customer’s guests or any other person in attendance at the event whether invited or not, will result in the customer being responsible for the cost to repair and/or replacement of the equipment (“Repair Costs”).
7.4 The customer is liable to pay Mr Incredibooth a cleaning charge of $100 if excessive cleaning is required to restore the photo booth to its original condition (“Cleaning Charges”).
7.5. The client agrees to pay for all Repair Costs and Cleaning Charges within 7 days from the date of any written demand issued by Mr Incredibooth. The customer will be responsible for all financial recovery costs if the Repair Costs and/or Cleaning Charges are not paid within 7 days of the request.
8. Safety of Mr Incredibooth’s staff and equipment at the event
8.1 The Customer is responsible for the security and safety of Mr Incredibooth’s staff and equipment while attending your event. This also includes during set up and packs down at the end of the night until we leave the actual venue premises.
9. Use of images
9.1 Mr Incredibooth will use and post all photos taken during the event on its website and/or social media accounts for promotional and/or advertising purposes. By agreeing to these terms and conditions you are deemed to have given Mr Incredibooth consent to such use of the photos unless a request is made to the contrary prior to the event.
9.2 We do not take any responsibility of any misuse, by third parties, of the photos we have uploaded on our website and/or social media account.
10.1. Mr Incredibooth will not be held responsible for any circumstances outside its control. This includes, but is not limited to, fire, riot, civil commotion, accidents, acts of nature and equipment failure. If such circumstances arise, all reasonable efforts will be made by Mr Incredibooth to provide service or find a suitable replacement service. If this is not be possible, the customer will receive a refund of partial or all payments received by Mr Incredibooth’s for the booking at our discretion depending on the circumstances.
10.2. The customer agrees to indemnify Mr Incrediboth from all third parties claims of damages or injuries arising from any inappropriate or improper use of the photo booth by the customer and/or the customer’s guest and attendees at the event location.
10.3. The customer agrees that in all circumstances, Mr Incredibooth’s liability is limited to an amount equal to the booking cost and not be liable for indirect or consequential damages.
11. Where the client is a company
11.1 The person signing the Booking Form warrants that he or she is duly authorised to sign the Booking Form on behalf of the Company.
11.2 The person signing the Booking Form agrees to guarantee the Company’s performance of its obligations under these Terms & Conditions, including but not limited to any payment of Repair Costs and/or Cleaning Charges arising under Clauses 7.4 and 7.5.
